These Terms of Service (“Terms”) govern your access to and use of SecondLight (“Service”), operated by SecondLight (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Description of Service
SecondLight is an AI-powered virtual staging platform that allows users to upload photographs of empty or unfurnished rooms and receive digitally staged versions of those photographs. The Service uses artificial intelligence to generate furniture, decor, and other visual elements within your uploaded images.
Account Registration
To use the Service, you must create an account via our authentication provider. You agree to provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Photos and Payments
The Service operates on a photo-based system. Each staged image generation consumes one photo. Restyling and revising previously staged images does not consume additional photos.
- Subscription photos are granted at the start of each billing cycle and reset when your subscription renews. Unused subscription photos do not roll over to the next billing period.
- When photos are consumed, free photos are used first, followed by subscription photos.
- Revision limits depend on your subscription plan. Free accounts include 5 revisions per photo, Starter plans include 10, and Pro plans include unlimited revisions subject to a fair-use cap of 40 revisions per photo.
All prices are displayed in the currency shown at the time of purchase. Payments are processed by our third-party payment provider, Polar. By making a purchase, you also agree to Polar’s terms of service.
Subscriptions and Cancellation
Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time from your billing settings. Upon cancellation, your subscription photos will be removed.
Refunds
Refunds are handled on a case-by-case basis. If a refund is issued, the associated photos will be removed from your account. To request a refund, please contact us via our contact page.
Content Ownership and Licence
You retain all ownership rights to photographs you upload to the Service (“Your Content”). You represent and warrant that you have the legal right to upload and use any photographs you submit.
You grant us a limited, non-exclusive licence to process Your Content solely for the purpose of providing the Service. We do not claim ownership of Your Content or the generated staged images.
Generated staged images are provided to you under a perpetual, worldwide, royalty-free licence for both personal and commercial use, including use in real estate listings, marketing materials, and portfolios.
Acceptable Use
You agree not to:
- Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Upload content that infringes on the intellectual property rights of any third party.
- Use the Service to generate deceptive or misleading representations of properties with intent to defraud.
- Attempt to reverse-engineer, decompile, or extract the AI models or algorithms used by the Service.
- Interfere with the Service’s infrastructure, circumvent security measures, or use automated means to access the Service beyond the provided interface.
- Resell, sublicence, or redistribute access to the Service without our prior written consent.
AI-Generated Content Disclaimer
The staged images produced by the Service are generated by artificial intelligence and are intended for visualization purposes only. They do not represent the actual condition, furnishing, or dimensions of any property. We make no guarantee that generated images will be accurate, complete, or suitable for any particular purpose. Users are responsible for ensuring that staged images are used in compliance with local real estate advertising regulations.
Intellectual Property
The Service, including its design, features, AI models, branding, and underlying technology, is owned by SecondLight and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written permission.
Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service at any time for maintenance, updates, or other operational reasons. We will endeavour to provide reasonable notice of planned downtime where possible.
Limitation of Liability
To the maximum extent permitted by law, SecondLight and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.
Indemnification
You agree to indemnify, defend, and hold harmless SecondLight and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Any remaining photos will be forfeited upon account deletion.
Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by posting a notice on the Service or sending an email to the address associated with your account. Continued use of the Service after such notice constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SecondLight operates, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
